These General Terms and Conditions of Sale govern purchases made through the 100carati.com website and form an integral part of the contract concluded between the customer and 100 Carati S.r.l.

These General Terms and Conditions apply to sales made through the 100carati.com website.

For the purposes of these terms, a Consumer is defined as a natural person who makes a purchase for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity they may carry out.

For purchases made by parties acting in the exercise of a professional or entrepreneurial activity, provisions different from those specifically provided for consumer protection may apply.

2. Products and Characteristics of Jewelry

100 Carati markets jewelry and precious items that may belong, in particular, to the following categories:

New: new jewelry that has not been previously used, with the exception of normal control, display, and commercial handling activities.

Refurbished: jewelry that was previously owned and subsequently selected, checked, cleaned, and, when necessary, subjected to professional interventions aimed at restoring its aesthetic appearance and functionality.

Vintage / Antique: jewelry from previous eras that may exhibit characteristics, workmanship, and normal traces of time compatible with its age, history, and previous use.

The category and main characteristics of the product are indicated on the relevant product sheet.

Photographs are taken with the aim of representing the product as faithfully as possible. Minimal differences in color perception may depend on the device, the monitor, or their settings.

For refurbished, vintage, and antique products, any normal signs compatible with the condition, age, and previous use of the jewelry, when adequately represented or described, do not in themselves constitute defects of conformity.

3. Authenticity and 100 Carati Certificate

Every piece of jewelry sold by 100 Carati undergoes the checks provided for by company procedures before being sold.

Each purchased item of jewelry is accompanied by the 100 Carati Certificate of Authenticity, in which the declared characteristics of the product are reported according to the verifications performed.

When the product is also accompanied by certifications or documentation issued by gemological laboratories, manufacturers, or other entities, such documentation is indicated in the product sheet or provided together with the jewelry.

4. Prices

All prices published on the site are expressed in Euros and include taxes applicable under the tax regime provided for the sale, unless otherwise indicated by regulation.

Before completing the order, the customer can view the total price of the purchase and any applicable additional costs.

For shipments to countries outside the EU, customs duties, local taxes, or other charges provided for by the destination country may be applied. When not included in the price indicated at checkout, such amounts remain the responsibility of the recipient.

Any price reductions, promotions, and indications of the previous price are applied in compliance with current regulations.

5. Product Availability

The availability of products indicated on the site is constantly updated.

Given the uniqueness of many pieces of jewelry and the possibility that some products are also marketed through other channels, a simultaneous sale or an availability error may exceptionally occur.

Should an ordered product no longer be available, 100 Carati will promptly inform the customer and proceed with a full refund of any amounts already paid, using, where possible, the same payment method used for the purchase.

6. Order and Conclusion of Contract

The customer selects the desired products and proceeds to purchase by following the procedure indicated on the site.

Before finalizing the order, the customer can check and correct any errors in the entered data and view the main information relating to the products, price, delivery, and payment.

Receipt of the order is confirmed through an electronic communication containing the purchase summary.

100 Carati reserves the right not to accept or to cancel an order in cases permitted by law, for example in the event of subsequent unavailability, obvious material errors in the price or characteristics of the product, the impossibility of authorizing the payment, or well-founded elements relating to fraudulent transactions, without prejudice to the refund of sums already collected, when due.

7. Payment Methods

The customer can use the payment methods available and displayed during checkout.

The actual availability of individual payment instruments may vary depending on the country, the order amount, and the services made available by the respective operators.

Information regarding payment cards is managed by payment service providers through secure systems according to their respective security procedures.

100 Carati does not store the complete details of the payment cards used by the customer, except as may be provided for and permitted by the payment services used.

8. Installment Payments

When available at checkout, the customer can choose an installment payment solution provided by third-party operators.

The use of the service is subject to the contractual conditions of the relevant provider, shown to the customer before the conclusion of the transaction.

The approval of the installment plan and the management of the installments depend on the chosen service provider.

9. Shipping and Delivery

Orders are entrusted to couriers selected by 100 Carati and, when provided, shipped via tracked and insured service.

The customer receives the information necessary to track the shipment when the tracking service is available.

The times indicated on the site constitute an estimate based on the normal timing of the service, without prejudice to the delivery deadline agreed with the consumer and the rights recognized by law.

The customer is invited to check the external integrity of the package upon delivery and to promptly report any anomalies.

In relationships with consumers, the risk of loss or damage to the goods is transferred to the customer when the latter, or a third party designated by them other than the carrier, takes material possession of the goods, except in different cases provided for by law.

10. Right of Withdrawal

A Consumer who purchases online has the right to withdraw from the contract, without having to provide any reason, within 14 days from the day on which they acquire physical possession of the goods or, in cases provided for by law, the last of the goods.

To exercise the right of withdrawal, the customer must unequivocally communicate their decision to 100 Carati within the prescribed period.

possibly indicating the order number and the product intended to be returned.

The option to use the standard withdrawal form provided by law remains, without its use being mandatory.

11. Free Return for Change of Mind

For purchases made by Consumers, 100 Carati bears the cost of return even in the event of a simple change of mind, according to the return procedure communicated by Customer Care.

After the withdrawal request, 100 Carati will provide the customer with the necessary instructions and organize the return according to the indicated methods.

The product must be returned without undue delay and in any case within the terms provided for by applicable law.

The customer is required to keep and handle the jewelry with the necessary care until its return.

12. Condition of the Returned Product

The customer is responsible for any decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods, within the limits provided by the law on the right of withdrawal.

The product must be returned with the accessories and documentation received, including the 100 Carati Certificate of Authenticity.

When possible, it is recommended to also use the original packaging or, in any case, packaging adequate to the nature and value of the jewelry.

Any absence or damage to the packaging does not automatically result in the loss of the right of withdrawal, without prejudice to what is provided by law regarding the possible decrease in the value of the goods.

13. Ring Resizing

When technically possible, 100 Carati offers the service of reducing the size of the purchased ring for free.

If it is necessary to increase the size, the intervention may involve an additional cost determined based on the material required, the structure of the jewelry, and the requested workmanship.

Before proceeding with a paid intervention, the customer is informed of the relative cost.

Some jewelry, due to structural characteristics, the presence of stones, workmanship, or materials, may not be modifiable or may only allow for limited variations.

14. Modified, Custom-made, or Personalized Products

The right of withdrawal does not apply in cases provided for by law, including the supply of goods made to measure or clearly personalized.

Should the customer request an intervention that, by nature and extent, makes the jewelry produced according to their specifications or clearly personalized, the exclusion from the right of withdrawal provided for by law may therefore apply.

Depending on the specific characteristics of the intervention, workmanship such as engravings, individual personalizations, and other modifications performed specifically based on the customer's indications may fall into this category.

Before performing a customization relevant to the right of withdrawal, 100 Carati will inform the customer of the relative consequences when provided.

This exclusion does not limit in any way the rights of the customer in the presence of any defect of conformity of the product or the workmanship performed.

15. Refunds

In the event of a valid exercise of the right of withdrawal, 100 Carati refunds the payments received from the consumer according to the applicable law.

The refund is made using the same payment method used by the customer for the initial transaction, unless otherwise agreed and provided that the consumer does not have to incur costs as a consequence of the refund.

100 Carati may withhold the refund until receipt of the goods or until the consumer has demonstrated that they have sent them back, if earlier, in the cases and within the limits provided by law.

Any additional costs resulting from the consumer's choice of a mode of initial delivery other than the least expensive standard mode offered by 100 Carati are not reimbursed within the limits permitted by law.

16. Legal Guarantee of Conformity

For purchases made by Consumers, the legal guarantee of conformity provided for by articles 128 et seq. of the Consumer Code applies.

The seller is liable for defects of conformity according to the terms, conditions, and duration provided by applicable law. For goods subject to ordinary regulations, the seller's liability concerns defects of conformity that appear within two years from delivery.

In the presence of a defect of conformity, the consumer has the right to the remedies provided for by the Consumer Code, including, when the conditions are met, repair or replacement and, in the cases provided for, a proportional reduction in the price or termination of the contract.

The legal guarantee also applies to refurbished, vintage, and antique jewelry sold to Consumers, taking into account the nature of the good, the declared condition, the age, the characteristics illustrated in the product sheet, and any signs or characteristics specifically brought to the customer's attention.

The guarantee does not cover damages incurred resulting from improper use, accidents, impacts, incorrect maintenance, or interventions carried out by third parties, without prejudice to what is mandatorily provided for by law.

17. Refurbished, Vintage, and Antique Jewelry

In assessing the conformity of a refurbished, vintage, or antique piece of jewelry, the characteristics declared in the product sheet, its condition, age, and previous use must be considered.

Normal signs of time or use consistent with the description, photographs, and declared condition do not in themselves constitute a defect of conformity.

The mandatory rights recognized to the consumer by the legislation on legal guarantee remain fully applicable.

100 Carati is committed to handling requests as quickly as reasonably possible.

19. Liability and Force Majeure

100 Carati is not liable for delays or non-performance resulting from unforeseeable events or, in any case, not reasonably controllable, within the limits permitted by law.

No provision of these General Terms and Conditions can be interpreted in such a way as to exclude or limit rights or responsibilities that cannot be excluded or limited under applicable law.

20. Privacy and Personal Data

Personal data provided by the customer are processed in compliance with applicable law regarding the protection of personal data.

The use of cookies and other tracking tools is regulated separately by the relevant information notice published on the site.

21. Invoicing

Customers who require an invoice are invited to promptly provide all tax data necessary according to the methods made available by 100 Carati.

For VAT-registered subjects, the data required by the regulations applicable to electronic invoicing must be provided.

Fiscal documentation is issued according to the provisions in force at the time of purchase.

22. Governing Law and Jurisdiction

These General Terms and Conditions are governed by Italian law, without prejudice to the application of any mandatory consumer protection provisions recognized by applicable law.

For disputes with a Consumer, the competent court is the one identified according to the mandatory rules applicable to consumer protection.

For relationships with subjects who do not hold the status of consumer, the different rules of jurisdiction provided for by law and by any agreements validly concluded between the parties may apply.

23. Changes to the General Terms and Conditions

100 Carati may update these General Terms and Conditions to adapt them to regulatory, organizational, or commercial changes.

The terms and conditions applicable to an individual purchase are those made available to the customer at the time of the conclusion of the relevant contract.

Any invalidity or unenforceability of a single provision shall not, to the extent permitted by law, affect the validity of the remaining provisions.
